Terms of Service
Effective October 1, 2026
Agreement
These Terms of Service govern use of HOA Engine by an association, its authorized administrators, board members, residents, and other permitted users. The person accepting these terms represents that they are authorized to act for the association.
The service
HOA Engine provides hosted tools for community operations, including records, communication, requests, documents, and payment-related workflows. Features may change as the service evolves. HOA Engine is a software provider, not a property manager, law firm, accountant, bank, or collection agency.
Your responsibilities
You are responsible for your community's content, the accuracy of records entered into the service, your users' access, and compliance with laws, governing documents, notice requirements, and payment rules applicable to your association. Do not upload unlawful content or use the service to harm, impersonate, or interfere with others.
Accounts and security
Keep sign-in links, credentials, and administrative access confidential. Promptly remove users who no longer need access and notify us of suspected unauthorized use. HOA Engine may suspend access that presents a security risk or violates these terms.
Payments and subscriptions
Paid subscriptions renew automatically at the selected monthly or annual interval until canceled. Fees are due in advance and are processed by Stripe or another disclosed payment provider. Charges for your association's resident dues are separate from HOA Engine subscription fees.
Data and privacy
You retain responsibility for the data your association submits. We process that data to operate, secure, support, and improve the service. Our handling of personal information is described in the Privacy Policy.
Availability and changes
We work to keep the service available, but do not guarantee uninterrupted or error-free operation. We may maintain, update, or discontinue features when reasonably necessary. You should maintain any records or exports your association needs for its own governance and legal obligations.
Limits and termination
To the extent permitted by law, HOA Engine is provided on an “as is” and “as available” basis. Neither party is liable for indirect, incidental, special, consequential, or punitive damages. You may cancel as described in the Cancellation and Refund Policy. We may suspend or terminate access for material breach, nonpayment, or security risk.
